Pl suggest
I am on H1, Wife on H4 ,
Moved from Company A to B, Company "B" Started GC processing
Wife H4 not transfered to Company B (was a big mistake)
Perm Approved
I-140 Premium Approved
Wife H4 is not transfered from previous employer .
Wifes (h4 visa and I 94 card has expired and Employer has filed for a extension before the expiry (got reciept form /number)
Applying for 485 for both (Wifes H4 Extension still Pending)
Q1: Will there be any issue while processing 485 as my wifes 1-94 is expired/ h4 is expired (is she legal?) . We still have the application reciept pending for extension which may take 2-3 months ), Pl suggest if we need to file any other forms.
Q2: While filing 485 do we/employer need to submit the Original Approved I-140? along with other documents?
