*** 485 pending since 11/02 is H-1B amendment needed for salary increase ***

My 485 has been pending since 11/02 and recently I got a salary increase and the lawyer is saying that she wants to file a H-1B amendment for the salary increase. Should one do that? Any laws you are aware of? Anyone in a similar situation? ANy thoughts appericiated?

Don't recollect filing an amendment for myself on salary increase. So I would say not, If your question is regarding how increase in salary affects your AOS, then you can rest assured it doesn't. You don't have to file any thing with regards to AOS based upon increase in salary.

With regards to H1 amendment I suggest you post this in the H1 forum, you will have much better responses for this question there.
 
Not sure why a salary raise should trigger an amendment. In our company we have quite a few people who are on H1 who got raises and immigration folks never mentioned filing an amendment. In fact when EVL was requested for AOS the revised pay was quoted. Change in nature of job, responsibilities or location (I think more than 50 miles, not exactly sure) will require an amendment. Are there any such changes in your job?

I think your lawyer needs some money. Probably he/she is thinking "if my client gets more money, why not me???"

Unless you are salary is increased significantly within a year (50% or 100%) there is no need for amendment.
 
Thanks all for your replys....I do not have any changes as far as location etc. Basically doing the same thing as I was before and no such luck of 50% or higher increase.
