485 Pending: Recvd. Code 2 notice: Wife and kids in India

Need some input from some gurus. Recvd a Code 2 notice for myself, wife and kids with appointment date Aug 2, 2005. Wife and Kids are in India.

Should I call them back.

United Nations and other gurus. Any suggestions. Looking for ideas!!!

It all depends on when they are planning to come back.....I would probably not call them back, if they will come back within say 2 weeks of the appt. date.

In any case, you should probably go as scheduled and send the request for rescheduling for the others. Rescheduling will delay your case for sure (in any case you are kinda stuck till Oct 1st - so may not be a big deal to reschedule).
Also given your PD, you can probably afford to reschedule as you still have a significant "wait" ahead in any case.

Do NOT ignore the notice -- uscis may consider the 485 abandoned !!
Either go or send it for rescheduling.
 
Vasodagama is EB3 India (retrogressed country), why did he get biometrics notice?? Does it mean any thing?? Is it ready for approval??

NSC is working on EB3 cases. They have not stopped working on them. They are working but they are not approving since no visas Available. They are making all the files ready.

Onthe notice itself it will sate the appointment date and also will tell that if you miss then you can complete before some date. so Make sure your family return by that date. If they are not, then either you or your attorney Can Reschedule their appointment. But there is a fair chance that their case status will be inactive until they complete. So do not take risk with NSC. Talk with your lawyer and make a decision.

Also it looks like sending of the biometrics notice is an automated process .... looks like they're picking cases based on either PD and/or date of the last FP and sending this notice.

I don't think it matters if the case is EB3/2 or retrogressed. This is a good thing 'cuz your files would probably be almost approved by the time visa numbers become available.
 
I am also in same position , my family went to india..and they got biometrics notices yesterday to go for it on 07/30 but they r not coming up to 08/26.

So I called my attorney and she told its not a problem she will reschedule it...!!

I also got my BIO notice yesterday schduled for later part of July. But I'm not expecting approval sooner than Nov/Dec'05. Do you think I'm optimistic?

Important Update

Thought you all should know. Talked to 2 lawyers, one from Murthy's office, they said it would be prudent to call the family back the appointment. As the application is with NSC and we all know how NSC works, it is better not to reschedule. There have been cases where the rescheduling request was made and the next Code 2 appointment was given after 8 months (Do you still wonder why).

Thank you all for your suggestions. Will keep you all posted if I find out anything to the contrary.
