Hi friends,
Here is my status.
Working for a small desi consulting company.
EB2 India(PD Oct 2006) 140 approved. 485 not yet applied(missed during the fiasco).
H1B 6 years completed. got 3 years extension based on approved 140.
Now, I am planning to go back to India for few years. But still want to continue GC process.
1) If I go to India now, join some company in India, and PD becomes current in few months or years,
a) can I apply for CP for my existing GC process?
If so, what all items I need to make sure?
b) Is there any form I need to apply to convert from AOS to CP (since I selected AOS while applying for 140)
c) Can I join any company in India or do I have to be still employed by my US Desi Consulting firm?
d) What are the chances of getting GC approved by afore mentioned process since I have already left US and working permanently in India. Will there be any question to prove that I still want to be Permanent Resident in US?
e) Does my Desi consulting firm need to prove that they still have the original Job Offer valid?
2) Second option: Assume that, before I make this decision, if my PD becomes current and I apply for 485/EAD,etc,... while in US,
a) Can I still go to India after that and convert this AOS 485 into CP?
b) What is the procedure to do that?
c) Again, can I join any company in India and continue this?
d) What are the chances of getting approval/rejection in this case?
Please advise me on this.
