I am just about to file 485 and when i did my medicals, doctor told me that i have an inactive infection from TB ..barely noticeable in the chest X-ray taken.. now what do i do ? Should i go ahead and file 485 considering that its an inactive case ..will my case be approved ..or do i wait and take the medications ( might be 6-7 months) and then file ? I would appreciate your opinions on that..
please help.
am posting this to other INS center forums too..in case any one has a similar condition or know about it

I hope things get better for you.

I've heard of exactly the same case before( same TB inactive case). don't remember what happened to that case .. but it seems one is required to complete medication to get PR.

Consult your lawyer if you have one. In my personal opinion.. go ahead and file your I-485 , you will get an RFE and in the meantime continue your medication. It might be 8-9 months before you get your RFE.. and you might be OK by then.

Second option is just send I-485 w/o medicals. You will get an RFE (again this might 7-8 months) and get your treatment in the meantime.

(Please note that this is my personal opinion and I myself am not sure if this is the best approach)

Options

For whatever reason do not delay filing your i-485. Following are the options before you

(i) Go to any Desi/African/Asian doctor again. Explain him the situation. Almost every person from developing countries like India have some trave of TB. So they dont worry about that and write OK on your form. There is no rule that you have to send whatever this doctor gives to INS. You can take second opinion.

In my case the doctor in Houston did not even look at reaction. He took a fixed amount and asked me to come back after 2 days. He did not take chest x-ray but was doing skin test. By then he already filled in the forms. Never go to American doctor they do not understand the situation in countries like Africa/India/China/Mexico.

(ii) If you are not ready to do step (i) then send the forms right now. You may get an RFE later. In that case you have to go to an INS doctor again and get TB examination above. You can take a chance because as it is inactive IIO may accept it.

It all depends on INS doctor. he can either right your results are OK or he can mention you have to take medication and come for re-examination. In later case you will surely get RFE. But anyway your case will be moving ...
