485; Marriage; H1/EAD(Information needed)

Hey Folks...

Need help/information with a certain situation which others might have faced...specifically to Indian folks...

If your H1 expires and you are working on your EAD; Can you get married to someone who is in India.

If yes, Do you go through Adjustment of status in the US and does she go through CP (consular processing) in India? What happens to her paperwork regarding medical examination and Fingerprinting issues; How does she get that stuff done in India? Also, does she get her GC at the same time as you do (even though both will be going through two different processes...namely adjustment of status in US and CP in India) or do they come at different times. If they are processed at different times, do you know what is the estimated time-lag between the approval of adjustment of status in the US and CP in India.



Any help/information is greatly appreciated. Thanks a bunch folks.

As you have used EAD, you have nullify your H1b. Your wife wont be eligible for H4 anymore. Now the best choice for you is
" Follow-to-join" procedure which will be started after your AOS get started.

How to proceed that? Go thru the thread follow-to-join on marriage family based category. This is frustrating proceure and takes 6 months to anytime after you get your approval for I485.

Be certain that you get married before your I-485 is approved. Otherwise, you will be stuck with GC processing based on marriage to a PR and that will take more than 5 years.
