140 approved and 485 is pending since Dec 2004. Now, original GC sponsored company bought by another company.

Is this leads to denial of 485?
Am I protected by AC21? If yes, do we have to applyAC21?
Is anyone in this situation?
Please post your experience or opinion.

I am in the same boat, you need to use AC21 porability or file 140 change of company(something like that)

Relax, Take it easy.
Your attorney can file AC21 & you should be ok. Not sure if your new company need to ammend approved I140 petition.

I have gone thru worse situation than yours. The division I was working was sold to a new company, this was not a successor in interest case, so I140 was not ammended. I had to move to the new company before 180 days of filing I485. New company filed PERM & I140 in EB2 & attorney sent document couple of months back to port the priority date. I got my GC approval couple of weeks back(yet to get the card).

My PD is going to become current in next month. Both 140 and 485 filled in Dec 2004. 140 approved in Jan 2005 and 485 is pending since Dec 2004. In June 2007 my company brought over by another company.

Is 140 amendment must be filled by the successor?
Do we have to file AC21 now or wait for interview?
If we don't file AC21 and assume that the 485 get approved in next month, does this become problem because we are not working for the sponsoring company?
