485 inquiry while EAD expired

Please help me.

Here is my situation.

I just got approved for EAD (3rd) after an RFE. Husband still waiting (unpaid leave of absence for last 2 months). We got our FP1, FP2 done.

We want to open an inquiry on 485 as lot of lucky people are getting approved for Jan 2003 now.

My husband is worried that initiaing an inquiry on 485 (May 2002) might pop-up an employment RFE as he has changed job on EAD earlier keeping laws intact but didn't inform INS about it. Since he is on unpaid leave of absence at present and if he gets an emp. RFE, he will not be able to produce paystubs. Is it an issue???

Also he must be getting his EAD anytime as he has opened an inquiry after 60 days of RFE and hopefully he should be back into office within next 30 days with GOD's grace.

Is there any time limit to reply employment RFE so that we could gain some time incase his EAD is delayed further.

Please share similar experiences or shed your knowledge base.
 
Usually there is a 90 days period after RFE is generated, in which you have to reply. If you are confident you can get a job during that time then initiate an enquiry.
