I'm in total crisis situation here, and would appreciate your input on this.
My wife and I applied for 485 in March 2003. We already gave our finger prints a couple of times, and recently got an RFE on both of our birth certificates and marriage proof.
In the mean time, we (my wife and I) had some marital issues. Basically she was beginning to think that she wasn't getting enough attention from me. I'm a consultant and do travel on my job. My wife is a house wife with a 10 month old baby. Obviously she kinda felt all depressed being home all by herself. I wanted to change my job to get a rather non travelling job, but have been watiting for my GC before I do that.
My sister who lives a couple of miles away from our house is visiting India at the moment. My brother-in-law (BIL) started visiting my wife to take lunch boxes and have dinners everyday. One time my wife and I had a fight and she told my BIL how she has been depressed with me not being there when she needed me, how she is not being loved as much she was being used to..etc..etc. Well, after my wife and I had a baby our (atleast my) priorities changed and right now my baby is first thing in the world for me.
Then my BIL took advantage of her, seduced her away from me, and they got romantically involved. He sexually harassed her and made her do things she didn't want to do. My wife infactuated for him partially and they spent few nights together. One friday night (the weekend I wasnt supposed to fly back) I flew back home from work, and found these two sleeping together. When my wife saw me she cried and confessed everything. This guy took off from my home saying that its all my wife's fault. My wife confessed and so I wanted to give her another chance. Next day I called him and left him a message threating/warning him not to touch my wife again, not to visit my house. I also used filthy language in that message after all he did to me, and my wife.
Using that message on this phone, he filed a complaint from court that I'm threatening to kill him. So, court issued a complaint and a date of hearing. Unfortunately, myself and my wife went out of town for that couple weeks. And I never received that complaint and request for hearing. Since I didn't showup at court for hearing, they issued a warrant for arrest. I'm going to take care of this next week. But my question is, will this warrant for arrest go on my record and do we lose GC on this? I'm this close to get my GC now and would hate to jeopardize my existence in this country.
Please advise me folks..??
