485 for Spouse(PLease help)

My fiance is on a visit visa here in us.She arrived a month ago.I applied my 485 on june 22.Still have'nt recieved a reciept. My pd is Aug 2004,eb3(ROW). My lawyer told me to get married asap in court and then file for her 485.He said that he doubt that we will get my 485reciept before aug 17.
Can i file her 485 without my reciept.Lawyer said I-140 approval should be enough.Please let me know if its a good idea to file her 485 now since you dont know what will happen in the future whether PD will be current for her. OR Should i just transfer her status to H4.BUt then again it might retrogressed for a ling time. Please advise.

We had asked a lawyer one year back from converting visitor visa to H1B. That time, the lawyer told us that after 2 months on visitor visa, my spouse can change her status to any other visa. Otherwise the intent will not be proper.
Sorry I am not giving you a favorable answer here. But I donot want your spouse to be in trouble down the line.
Please ask some good lawyer as a second opinion.
