I came to us in 1998, worked with a consulting company from 1998-July 2000. The consulting company filed for my green card and my I-140 was approved in August,2000.In AUgust,2000 I left the consulting company and joined another company for a full time position. This company filed for my green card - labor etc. But, INS stopped processing because of layoffs by this company. I worked with this company on H1B till Oct 2001. I resigned and moved to India and worked there with an Indian company from oct-01-Oct02.
Now, I have got a job through the old consulting company and they are filing for fresh H1B.
Now, can I file for my I485 with the old consulting company on the basis of aproved I140 with the same company.
Please advice.
