Hi,

I have got my Labor approved in Perm few months back and applied for140 which is pending. Now that Priority dates are current, can I file 485 even if my 140 is still pending.?
Or should I wait till my 140 is approved?
can someone please clarify?

Also, I am planning to get married in few months. I heard that during 485 filing we need to include dependants details also.
So, should I wait till my marriage so as to file 485 for me and my fiance together. or can I file 485 for me now, and later include my dependant details after my marriage?
is it possible and advisable?
i am scared whether PDs can again retrogress back before my marriage?

can someone please clarify?

Thanks

Hi justcuriousaa,

Yes, you can file 485 even 140 is pending. Some are saying that with approved I140, I485 will be processed faster. But who knows how the centers process cases. If you wait for the approval, you need to be aware that visa number issue. If visa number is not available. You will not be able to file 485.

Yes, it is better to file in your spouse application together with yours. This way it guarantees the visa number for your spouse.
If you file separately, make sure that spouse's visa number will not fall under the family category because it is a long queue now.
Hope this helps!
