485 Filed three months ago,Spouse Laid off

Hi FRIENDS,

I(primary benificiary) and my spouse(derivative ) are on H1 when we filed for AOS.We got our 485 Receipts notices in November and we both have EAD and did not use it.

My spouse was laid off and not getting paid. Is my spouse is in out of status? Or 485 Adjustment of status keeps my spouse in status? Or does my spouse needs to convert to H4 Visa? Will GC will be denied to my spouse?

Any suggestions ?

Don\' worry

Don\'t worry. As long as 485 is pending one can never be out of status. As long as the pimary beneficiary is employed by the sponsoring compay for at least 6 months, there should be no problems
