485 EB2 Rejected non Availability Sept -6- VSC

What is the date till which the 485 Application be accepted for EAD...
1) is it going to be 8th Sep or Oct 1.
2) Will they accept my App if received after sep 8th??
Concurrently applied for 140/485 through EB2 on Aug 10
ND for 140 Aug 18, LUD Aug 22

Got 485 rejection Letter citing non availabilty of Visa numbers.
Lawyer sent back the 485 docs again with the 140 Notice receipt on Sep 7th.
 
I have contacted the VSC to find if they have received the 485 application and ther customer service ppl said that they cannot disclose any info to me and asked the Employer or Lawyer to contact.

But I saw in a post that a benefeciary(me) contacts the case will most probably be rejected is that true??

When I asked my lawyer to conatct he said lets wait for the receipt for 485, no need to contact.
 
I am in the same boat with you. My I-485 along with AP and EAD was returned for the same reason on August 31st. I sent back my I-485 along with my wife's on September 7th, and I still did not receive anything yet from them.

I think Visa Number for EB2 was already not available back in August, so I think it is useless to send in the application again, but we need explanation that Visa Number was available in the official Visa Bulletin both for August and September and the contradictory documentation from USCIS and subsequent rejection.
 
I dont think thats the case as I saw some posting abt people who applied after Aug 8th and has FP notices.
Lets hope for some good.
wht abt that calling service center maybe bad thingy??
 
I sent in my I-1485 on August 23rd, and got rejected on August 31st. I do not think this is a mistake since I know from a lawyer in NJ that one of his client's I-485 was also returned in September citing the same reason.
 
There aer a bunch of ppl in same time line whose EAD was approved.
Hopefully this is true.

Also as asked before is it considered bad idea calling the VSC for finding status about the 140, cause I wanted to know about my EB2 485 case, which was rejected.
I read in a forum that usually when ppl call for 140 status it gets rejected??

EB2 for Indians got retrogated to Nov 99, and EB3 even got kicked back, this sucks... How many people US want to send back to India in GC frustration? Did any one has a history of how and when these retrogation dates has changed in past for Indian?

Will they process our I140 or will they wait for 485 numbers to get current before they work on the I140. What do you think?

LUD changed today, hopefullt at the least they have accepted 485 EB2 App and joined 140 and 485 together.
All others whose EB2 has been declined due to Visa UNavailability in Aug-Sep 2005 and reapplied do You see any LUDs on 140??
 
USCIS will accept EB2 or EB1 till 30th sep.

u can file 485 (eB2 or eb1 ) till 30th sep.Ask your lawyer to take care of this.My son's (dependent) 485 ( eb3) application was received by TSC on 30th dec 2004.They asked for one doc (copy of 140) after 2 weeks in Jan 2005. My lawyer replied as its concurrent hence there is no 140 approval letter.Then they said ,it should have been to local office rather then to TSC.Again we cited NO this type of case are handled by Service center.Then they said ,Visa unavailablity and refused to accept the 485.Then we move to higheir up regional commisioner etc and they asked us to send them (regional boss) and they forced the USCIS to accept the 485 as the date my application reched USCIS ,the visa number was available and USCIS accepted the 485.Hence don't worry.Just tell your lawyer to prove his caliber.One more thing these folks who works for USCIS does not have brain.Several times I have done their CAT scanning,nothing was their.Just some virtual buffer memory no CPU.

That's great news!!! I re-sent in my rejected I-485 on Sept 7th too, but still did not get anything yet.

Those u send their i140/485 applications to vermont centre...can let me know
knows how much time it takes to reach i140/485 application to Vermont centre if i send it on 21th sept.
