485 Denied, MTR Sent

My 485 was denied and the MTR has been send as of 03-18-05. This day was Friday.

My questions:

Whats the next thing I should be watching? How many days will it take them to process the MTR? How can I track whats going on? What is their pattren on processing this kind of a case?

I think you will recieve an EAC number. I am sure you will soon get 485 approval and dont worry. God is there to help you
 
Yes i already got 140 approved.

Anybody has information about my question. How would the process go further?

Hi Desiladka,
Within few days u will get an EAC# for 290b which u have filled now...
Then anywhere from 30 -60 days u will see something on ur MTR...it depends upon each case.
We filled MTR on feb10 and got case opened yesterday...that too its opened only for primary and we see LUD changes in I485 ,I140 and 290b for both primary and spouse....
For primary I485 it says "ur case reopened on BCIS motion....."
ours is an AC21 case with employer revoked approved I140 and also out of status issue....
This is the idea i have abt MTR....

When u say ur case is AC21 and out of status... Did they deny ur I485 because u did not satisfy their requirements for AC21 or is it due to out of status

I485 denial...

Hi chinnakmm and havemercy,
Our I485 was denied due to out of status reason...when we filled I485 ,H1 was pending at CSC center...my lawyer did not keep a correct note for that...so VSC thought we were out of status when I485 was filled.
Now we have approved H1 and filed MTR.
Meantime during this I485 denial period old employer revoked our approved I140...since we already got I485 denied we din't get any letter for this I140 revoke...now for safer side we have filed AC21 with MTR.
we see LUD changes in I140 now after MTR is opened....
So now we have to overcome out of status problem and AC21...
hoping for good to happen.

The reason i asked is because i have also used AC21...

Changed job after I140 approved and I485 pending more that 8 months..I Did send AC21 documents immediately after i joined the new company..

My old employer revoked I140 after i left him and my lawyer who happens to be the same lawyer for the new company i joined got the letter last week confirming that my I140 is cancelled,,

This is the LUD pattern i observed in my case when they cancelled my I140. First LUD Changed both on my I140 and I485 on 10/10/2004 and for five months there was no activity... And on March 12 they mailed the letter to lawyer saying my I140 is cancelled... And on March 13 lud changed on I140 only and not on I485....

But remember all these LUD changes did not have any status message changes.. It is still showing case approved for I140 and FP received for I485.

I dont know where my I485 is now. I cant understand why they did not send any info on my I485 Which is all ready to be adjudicated because my FP is done and the namecheck for me and my wife are also completed..

Infact my lawyer also did the first inquiry two weeks back and i have to wait for another 15 days before we can call them again

Tell me please , when you wrote that your case was revised by BCIS, how do you know that? And which form did you file 290 A or 290 B?
Actualy who revised the case : the same officer or someone from the higher level?

we don't know the result yet...our MTR has been accepted and case is reopened last week.....we are waiting for the decision...
we filed I290A....so we r kind of still keeping the fingers crossed to know the result.....

My I-485 was denied by Dallas INS as my I-140 was revoked before 180
Days at the time Dallas district office Interview on February 17, 05. Until today, I did not receive the denial letter. How long does it take to receive
the denial letter from INS? Can I file MTR? Please reply at your convenience

About your question. I really dont know. I found out that my 485 was denied when I received the denail letter. My online status never showed denail. Still does not show it.

Please provide details. I mean when you received denail. When you files MTR, when they received MTR, when you got EAC for 290. What it shows for 290 now, what it shows for 485 now? Date changes, and whatever you can provide.

All info will be very helpful.

I485 denied - 12/16/04
copy of denial letter received - primary 1/29/05,spouse 2/7/05
MTR filed - 2/9/05
MTR RD - 2/10/05
MTR ND - 2/15/05
EAC# for I290A - 2/25/05
MTR was approved on 3/23/05....got email for this.

The message in I485 says "This case reopened on bcis motion...." it also says it will take from 320 days to 540 days to make decision....I don't know how to believe this.
The message in I290A says "we have mailed u a receipt...." .The message in I290A doesn't change after MTR approval too..its same like before....
only message in I485 changed...
its almost a week and no results yet...
The LUD in I140 keeps changing everyday....but no message change.....i guess they r keen abt AC21 because approved I140 was revoked....
No LUD changes in I485 for the past three days....
Hoping for good....
I guess i have given some details for u which i know....

Thanks for the update.

Your MTR is approved. So I think that means all the conditions for denial have been removed from your case. The reason they still did not approve your case could be becuase of several reasons including finger printing, name check, priority date not current yet and so on. The list goes on...

What is your catagory? Is it EB3? which country are you from? Whats your PD?
 
If MRT approved

My lawyer told me that if MRT approved it means that they did not dismiss the case outright, from that point it would go back for consideration and the result might be dual. I will be very happy to be wrong. Please correct me.

so kind of tensed abt of the decision.

My lawyer told me the same as Akatu's lawyer. If it is 290A, MTR open, then they will look into all the papers, and they will decide to approve or not. Longer it will take, I do not what the result will be.
