485 Denied (mtr) and got approved i140 from newcompany

Hello everybody,

485 was denied because old employer revoked i140.
Applied for MTR and more than 5 months. No response yet.
Check my signature for details.

Now i have approved 140 from new employer with
eb2 Priority date: 04/2005.

Now my question is since priority dates will be current in July ...
can i submit to uscis in July ... my new approved i140 for the old 485 .
Or do i have to file new i485 .

If you used AC21 to move, then even if your old employer revokes your I 140, your 485 is still valid. Since you have a new 140, it is better to file 485 afresh. REsponse to MTR may take several months.

what happens to my old 485 when mtr is approved if i file refresh.

In that scenario, you will have to withdraw one 485. You can only have one pending 485 at a time
