485 denied due to USCIS error? Please Help, motion to reopen.

Our 485 was denied on the basis of denied 140(but the 140 on the notice is not ours), our 140 status is eb1 pending, NIW 140 approved.

Last time we post and got kind and useful advice on how to deal with the situation. We are really thanful for all the kindness. We are in a very hard time. Our lawyer could not help us because he is busy.

We intend to file a motion to reopen but do not know how to do that?
Should we use 209b? What writing style should we choose? Do we attach any other fom? What about the fee?And is there a template for writing the motion to reopen.

If anyone had the experience filing motion to reopen, please help and advice.
We really need to settle them soon. Thanks in advance.
 
Find another lawyer fast. MTR is not the type of thing you want to do by yourself, unless you have done intensive research and know what you are doing (and if you knew all of that you wouldn't be on this forum asking these questions).
 
485 denied, motion to reopen denied due to lack of I-94. New evidence found.. need your advice!

I filed for I-130 in sept. of 2011 which was approved. My lawyer then filed for I-485, had my interview in NYC in april 2012. I was denied because I didn't have I-94 and they couldn't find me in the system. I had filed the application to receive a duplicate I-94 back in 2008 which came back with nothing either..

I filed for 290 B motion to reconsider with affidavits from relatives and stuff, that was denied as well.

Recently a friend of mine had some connections internally at the homeland security and found me in the system. USCIS had entered my dob as my Indian passport I have been stranded for the last 3 years with no status, lost my job all because of a stupid mistake on their part.

I have been told that now motion to re open is the way to go. Does anyone know if I am on the right track. Though I have a lawyer but I am a little skeptical of him and want to verify all the facts. Also in cases like this where USCIS was unable to provide me my info causing me delay, what is the timeline?

I'd really appreciate if you can provide me some info!

Refile I-130/485 clearly mentioning denial of previously filed I-130/485 and the reason for. Include form I-102 and mention date swapping reason.
