I485 for my wife was denied due to a screw up at the attorney's end. The other application is still in process. Wife's H1 has completed more than

With the priority dates not moving my wife cannot reapply till the date gets current. Long story short... we cannot afford to live in our current place on one salary for too long.

Question for the forum members:

What are our other options?

Please complete the sentence and explain more facts about the case so we can provide a useful answer ... what was the reason for denial, what was the attorney's mistake, what is the priority date and category and country for the denied case, when was the denied case file? who is the primary and who is the dependent, or are they both based on two separate I-140s or I-130s?

PD May 2003
I140 and I485 concurrent filing June 2007
Wife's 485 filed simultaneously
I am on H1 and I140 approved
Wife was using the EAD
Both have completed 6 years on H1

Denial notice May 2009
Appeal filed June 2009
Response received July 2009
We still have not received the hard copy of the the denial notice
Mistake was that on the wife application the previous attorney checked of that she was the primary applicant not the beneficiary
