485-Approved and Stamped

GC Approval

Me, my wife and one of my kids' GC is approved and stamped on Dec'31 at Newark. The other Kid's, who turned 14 years, is still pending.

My details:

EB-1, Multinational Executive
Rd: Nov' 30 2001
ND: Dec' 14 2001
1st FP: Apr' 2002
Changed Employer: Nov'02
RFE: Responded: Jul'02 (Usual stuff...employment letter. letter, W-2 and Pay stub )
2ndFP: 2nd week Sep'03
Status Query-1 End Oct' 2003- no response
Status Query -2 Dec' 17th, 2003
Approval: Dec'19 2003
Letter Recd: Dec' 29 and stamped on Dec'31

Other Details:

Used AP for business travel 4 times
3rd AP was stuck with VSC when 2nd AP expired. Approached local office and obtained a AP for business travel during Nov'03

Though I am not an active member of the forum, I do visit and see useful information and I am obliged to share mine.

Congratulations. It is interesting to know that AC-21 was accepted for EB-1 case which was creating lot of dilemma.

BCIS was informed of using AC-21 only during the response to RFE.

I initiated both the status queries through phone. More information was asked during the 2nd status query, such as e-mail ID, which gave me an impression that my first query was not properly initiated or never initiated by the lady I spoke with.

AC21 doesnt come into picture here

looking at the dates>-
job changed Nov 2002
RFE respnded: July 2002.
so he/she was at same job when RFE came. Or may Gc Approval may have dates wrong if Ac21 was used (according to the posting).
I have seen some EB1-Multinational use Ac21 successfully. It will again be more helpful if GC Approval gives us the dates or the way he/she went about it.

congratulations ! Could you please answer the query raised by ag28 ? Eb1 and AC21 was grey area, nobody could confirm whether AC21 would be applicable to EB1 filers since there aren't too many Eb1's. I myself is EB1 and would like to know the details. Also is your current job /position similar to u had it before(L1A) ?

Please reply as there is no way to get more information for Eb1 filers. Thanks and have a great new year.

Good observation. It was a typo. My RFE was responded in Jul’ 03 and AC-21 was mentioned in the response to RFE.

I agree with you that there aren’t many EB-1 experiences. I will be glad to respond to any of your questions, if I have an answer. It was my concern too till I got the approval about the applicability of AC-21 for EB-1.

My changing employer is not by choice; but out of compulsion. My first employer went out of business.

As you may know multinational executive is a category in EB-1 and my job title was not ‘Multinational Executive’

Both my new and old job title and responsibilities were exactly the same.
