I have a problem which I hope someone among you can let me know what to do. I got married in the month of may 2004 and then I came back to the united states in the month of July 2005 hoping that my wife would join me shortly. But she was refused a h4 visa twice asking for more documents. She was asked for w2’s for the all the years I’ve been in the US. She went again to the Chennai consulate in a couple of weeks time with the documents and again she was refused, this time they asked her to get the original LCA, petition and 129 documents. My company had messed up with my taxes and they didn’t show up properly according to the LCA. But now I have amended all my taxes to show the amount as mentioned in the LCA and all those things. In the mean while a company B filed for my green card(receipt date 16 December 2003) and I got my EAD and 140 approved, while my 485 application is pending. I also finished my finger printing on the 9th of November 2004. In the mean while my green card attorney after my marriage amended my 485 to add my wife’s name in the 485 application.
My question now is :
Now should I send my wife again for H4 with the documents for the third time?
Or
My other question is can my wife who is still in India after my 485 approval(hoping it gets approved soon) go to the consulate and appear for consular processing.
What is a better choice.
Please let me know.
