45 day time limit to file LC with I-140

I have an approved RIR labor certification last 8/26/06.

Can I still file it this May 2007?

Or is this labor certification already dead?

Did you consulted with your immigration attorney? You have to act real quick - the Labor Substitution elimination rule with 45 day window to file I-140, is about to be published (source immigration-law website).
 
It is not dead.
You can still file, and, once once rule gets published, you will still have 45 days to file (if not substitution).

My lawyer has not been responding to my queries about this on point query via e-mail.

I researched this the whole night last night. You guys are right, once it is published in the Federal Register it is the law. The 45 day limit kicks in.

I worked on the paperworks the whole evening last evening for signature and mailing today.

Whew!
