45-Day Rule for LC Validity

Will this rule effect only for substitute Labor? i.e.., an employer can substitute another employee within the 45 days of labor approval?

OR

Will this effect all Labors that were approved, even though the same person for which the LC was filed?

Reason being I did not applied for my 1-140 yet and I want to get the 7th year ext on approved LC which was field 365 day's back.

Any thoughts?
 
The 45 day validity is applicable only to labor certifications approved. It does not apply to labor substitution.

The proposal that puts a validity date to approved labor certifications is at the tail end of the rule-making process. Once it is published the 45 day validity of approved labor certifications will be effective either immediately or 30 to 90 days after publication.

Conservatively, if you have an approved labor certification, it is recommended that you file a corresponding I-140 immediately before the proposal is published.
