Hello ,

Iam in US right now on H1. I have applied for GC (Still in 1 st stage(LC)). Iam going to Chennai consulate next month when i visit India as i have to get my H1 stamped. In form DS 156 it asks

36. Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?

What should i anser for this? As i have filed for GC and if i answer yes will they reject my H1 application saying that my intention is to stay in US.

If i say NO will they know that i have filed for GC and say that i lied and reject my application.

Please let me know

Nope. Till your 140 or 485 is filed, there is no immigrant visa petition to my knowledge.

And they cannot deny H1/H4 based on the fact that you intend to immigrate. Unlike F and B visas, you CAN have intention to immigrate and still qualify for a H visa.

Relax and get your documents right. It'll be a peice of cake.
