3 year extension of H1-B (Change from H4 to H1) visa after six years

Here is my case.

Completed 6 years in 2003.
Didn't apply GC and changed my status to H4.
Now got EB2 labor and I-140 approved.
Can i change my status from H4 to H1 and get a 3 year extension with the new law which came out in Dec 2006.


Any help will be much appreciated.
