Here is my situation:
I'm currently on H1B visa with company A and I have 6 months remaining to complete 6 years. Company A had filed I-140 and it was approved 7 months ago (Dec 2006).
Now, my project with company A is ending and I'm planning to join company B.
My question is - can Company B request H1B transfer and extension for 3 years based on Company A's approved I-140 since I-485 cannot be filed now because of quota unavailability. (Company A did not file for I-485).
Please respond ASAP. I have to make URGENT decision based on this.
