I applied for a lobor thru Delaware in May 2003.Priority date was May 15th, 2003.But my emplyr had to withdraw the case in Aprl 2004 and my petition for 7th yr is rejected which I came to know thru fax from BCIS just 4 days before (july 15th,2004 precisely) the expiry of H1 on July 18th,2004.BCIS gave a month period in case if wanted to apply on that denail.I contacted 2 to 3 attrns who adviced to leave the country ASAP. I left on Aug 8th and reached India Aug 10th. This made a stay in US out of H1 from July 18th to Aug 8th, for almost 3 weeks.The I-94 stappled in Passport is taken by airliner staff. My Qstn here is:
1) When I apply for a fresh H1 after one year stay in India,what are the chances of BCIS approving it.
2) What are the chances of getting VISA at US embassy.
3)ANy one with this kind of exprnce,I would like to share their expr.
Any advice on this is really appreciated.
