2nd RFE on I-140

We received on RFE on Aug 10 for I-140 requesting certified tax returns...

After we sent that on Nov 7th, same day they re-issued another RFE saying that the concerned person did not sign the tax forms!!

These are certified by IRS - why the hell do they want them to be signed by the president??

Also now they are asking for official academic record of advanced US degree...

I did not send them the transcripts earlier - I intend to do that now..

Any idea what these guys are upto?? other than that they want to make my life miserable!!:mad:

A letter from the CFO can also help in supporting the tax returns, if you can ask your lawyer to get in touch with the IIO and find out the exact details that would make things easier.

As far as the transcripts are concerned, i hope you have had then evaluated, if not please get them. If its a US transcript, you are okay.

Have patience and wait, that the least you can do.

I am waiting for the lawyer to get back to me on Monday to give details, was talking to her secretary who did not know much..

the transcripts are US so at least the INS will not question that too much...

hoping for the best! Almost 4 and half years and have not even cleared I-140!!! It is so irritating.

I really feel sorry about your case. When i commented earlier about some farm worker sitting in NE who wants to be a sadist, Mr James Mills went off on me. He said i was too judgemental, blah,blah. The reality of the system is it is completly flawed. So flawed that it has become a scheme joke.
The laweyers, the INS thinks this is some kind of scheme,either to make fun of people or to make money of people which ever applies.
There is nothing people like you or me can do. Just Bear with the fools. I have seen many a case where they had to go to appeals for years only to be finnaly laughed at and approved. so..
 
Sorry Mr. Mills. I did not intend to target you in my post. I was just commenting on a system where 4 + years for a process that should take a year or two has become a common.
I am not expect that any system would be perfect, but i would not agree to the fact that this system is not flawed.
I am ( i am sure ravisimi is also) tired of people saying its the line. This has nothing to to with the line. people behind me in the line have finished seeing the movie and went home. I and people like me are being bullied by the bouncer. That is the frustrating part.

I am sure both of you do have valid points .. I dont wantto jump the gun here and yell "incompetence or Prejudice" or anything...

but I do feel that there should be a simpler system..

For example in a case like mine, where I have been with the same company for 5 years and the Company has been around for 7 years and labor itself takes 4 years, suddenly the INS questioning about the ability to Pay salary and send 2 RFE's seeems pretty unreasonable..

I would agree with them if they did something like this with someone in a new company and had labor cleared in 6 months where INS needs to be more due diligent in making good decisions....

Look, every case is different and there is no lack of INS incompetence either. There are plenty of problems. Problems lead to accusations that are sometime warrranted and sometime unwarranted. Obviously, we could use a more rapid adjudication system but right now itnot a huge priority with the government. The last word that I heard from AILA in Washington D.C. was that all the government wants to talk about now is security. It appears that 9/11 changed everything and you guys are feeling some of the consequences (the system was screwed up before but 9/11 has made it much worse due to the new security checks, the slowed economy causing lower corporate profits and greater DOL scrutiny of LCs and the government being uninterested in improving the situation). Unfortunately you (if you want to stay here) and I (if I want to help people stay here and provide my family with food and a dry place to sleep) need to just deal with the problems as best we can.

The problems are nothing new. Last year I inherited an H-1 extension case (the beneficiary worked for the company for 3 years, was paid for the entire period and clearly met the H-1 requirement - no issues) that took 10 months to get approved! I've handled extensions that were approved in days. The longest H-1 case I ever handled was approved in 11 months (2 RFEs and a letter of intent to deny) but I also handled an H-1 case for the same company that was approved (before Premium Processing was available so this was normal adjudication) in 4 days.

Guys let as just be patient as we came to this country and also remember if they had made it easy the whole world population would be in America, I know there some fruatrations here and there but what to do. Patience pays
 
The system may be slow at times but policies are getting much better and liberal - for example, 7th year H1 extensions due to delays, concurrent filing, etc. This is going to be really useful to people. Not sure who has lobbied for these things as I assume that H1 workers do not form a constituency; maybe employers have. I have personally found that "knowledge is power" and that these websites are extraordinarily useful. I, infact, have complaints against all my former attorneys rather than the INS and the info from these websites has given me a lot of confidence in dealing with the attorneys - many of whom have their paralegals type wrong info on the forms, give you misleading advice, etc. I'm sure many are good but the 2 that I have had were pretty appaling (and no cheaper than average). For example, didn't your attorney tell you that you need to have transcripts and company tax returns for I-140? Actually mine didn't either but I saw it written on the LC as a requirement.
 
As a point of fact, my attorney did submit the Tax returns, however they were unsigned by our boss.... they were only copies... so the INS is asking for certfied.... and no my lawyer did not ask me for the transcripts.. so that is a bummer!! But, I am not here to complain about my lawyers, I have already changed once and they are all the same....

either way, the point is that when we already submitted certified tax returns from IRS for the first RFE, why are they asking for signed copies by our President of tax returns?? That sounds retarded!!!!!

And I am aware of the H1 extensions, that sure is good for people.. like me - I am on my 8th year of H1B - 2nd extension, considering that I have been in this country for 11 years and have not cleared my I-140. Should be some sort of a record... I should be given an honarary citizenship just for being able to pull this off :cool:
 
I called my lawyer today and she said that she did receive the second RFE on Friday but she did not take a look at it yet.. she will review it on Thursday and get back to me....

Are all lawyers like this??? "Dont give a s&*&%* about your green card" attitude???

They just dont have the sense of urgency that is required?

Jim, you are a lawyer - what is this complancy all about with these folks?
 
Lots of attorneys take on more work than they can handle properly. That's probably the most common problem but lawyers are people and we have problems just like everyone else.
