2nd marriage and immigration

i'm an f1 student and my first marriage was in ny state in a mosque and i obtained my nikkah nama .i went to city clerk and applied but because my first husbands an f1 student passport was expired they refused to process the application.
i got divorced but never received divorce papers and he left the country.
now i remarried again to us citizen and i'm about to file for immigration.
my question is do i mention my first marriage. if so i don't have divorce papers plus my marriage to my us citizen husband won't be valid. is there a way uscis can find outmy first marriage plz help???
 
Where was the first marriage terminated? The county clerk should be able to help you get a copy of the divorce decree - IF it was filed with the county clerk.

Since I don't know the details of your customs and I don't know what a "nikkah nama" is, this might be a dumb question but ... was the first marriage ever LEGALLY registered anywhere? If you couldn't get it registered originally, is it consider a legal marriage in the eyes of the USCIS? I'm not saying that the first marriage was not legal, but I was just wondering if the USCIS considers it legal.
 
if you signed a certificate of marriage in a mosque, it is the prophets responsibility to mail it to the city and then you will in return get a sealed certificate from the city in the mail withinn a wek of the prophet filling it.
So i will say you check with the city's record ofice to confirm that, and if you are not registered still do mention that you had " COMMON LAW MARRIAGE" and in that case go with any picture that would verify that. etc..
but do not try to hide that fact.

You should make sure the marriage was never registered and you are divorced legally before anything.
