2nd Interview after almost 2 yrs time!

Just a update for all of you waiting for GC after interview.......I will make my story short....My interview was on Sept 8th, 2004 for AOS, Interview went well but lady told me that my BAKGROUND check was pending at that time and I would be recieving the decision on my case with 1-3 months. Anyway It had been almost 20 months since my interview and I haven't recieved GC. Well I tried to inquire few time with the congressman as well but nada.......last month I again finally :mad: called 1 800 number (INS) and asked about my status. The gentleman was very nice and he took my information and told me that I would be recieving letter from my district office with in a month( by the way I forgot to mention, I moved from NY to NJ in last summer and I applied initially to NYC center and filed for AR-11 in last summer). Anyway like 2 weeks ago I recieved a letter from my local district office that IF I DON"T HEAR FROM THEM WITHIN NEXT 6 MONTHS, CONTACT THEM AGAIN. I said OK :eek: .......then I recieved my fingerprinting appointment for AOS (it's been more than 15 months since my intial fingerprint and biometrics) for May 03,2005. but almost a day later I recieved another letter from my local Distrcit office for an ANOTHER APPOINTMENT FOR my AOS INTERVIEW. yes another INTERVIEW. so my question is: Is it normal that you will get 2nd interview when you moved to new location after your 1st interview? well they asked me to bring completed medical form (which i did submit with my first application as well) letter of employment for me and my spouse, pay stubs for both, proof that we have been living together, I am assuming wedding pics, joint bank accounts, car insurance, medical insurance and home phone and cable bills would be enuf ( that's what we sent last time). Also one more thing mention in the letter, that if I have submitted affidavit of support first time then there is no need to bring that, well I did brought affidavit first time cuz at that time I was not making enuf money but now I am making more than enuf for last yr and 2 to support my self and spouse (who is by the way full time student till last december, graduated in Dec 2005 and now applying for Jobs).

What do you guys think about my situation. ? especially about medical form and affidavit of support? Should I go for another medical exam (even though I submitted it at my first interview, way back in sept 04) and affidavit of support, though I am making enough money myself for last year or 2 according to my Tax returns, should I have to bring affidavit of support from my relatives or my tax returns and pay stubs should be enough?
 
Well probably everything get mess up since not only because you got stuck in the fbi name check but then you move and all that stuff.

I would update the Affidavit of Support and Medical Examination since has been 2 years since the last update. I know that there is a memo about Medical Examination that is suppose that is valid until the interview date, but who knows if all the adjudication officers know about it, so better be prepare.

Thanks for your reply, yeah I would be going for another medical exam (another $300, I hate that) but I am not sure about affidavit of support, do I have to submit the Aff. of support from the same relatives that I originally did or can I use my w-2 and tax returns for that purpose? I don't want to bother them again .... :)
 
You got me in that one...have no clue. I think if you and your wife make over the poverty level then you can do a new Affidavit of Support, just bring it with you at the interview since they haven't ask for it and bring the transcripts of your last tax returns. Remember if they don't ask for it, don't volunteer it just in case they found out like "oh no we want the original people of your Affidavit of Support" which does not make sense, well for me...anyway not all make sense in life, does it?

In any case, you can wait if others have something to come up wtih since I really not sure about the Affidavit of support if you should come with an updated one from the original sponsors.

I ll tell you what i did about med exam to keep it current. I just went to the same office where i took it. They took new forms, copied all old info and put the new date. It did not cost me anything since i paid them months ago.
 
thanks aniretake for your idea .....but I am not sure I would be able do it or not as I have moved from NY to NJ last year. I first done my medical in NY (Long Island) area and I really can't remember who the doctor was? well I am gonna dig thru information/documents and hopefully find some clue of that Doctor :) . I am trying to use search locator on INS site but appearantely It is not giving me that Particualr Doctor name. May be he is no longer INS authorized civil surgeon. Also I m not sure about the STATE WIDE Restriction. Do I have to do the medical in the NJ or what ?

Well I looked into my medical records and finally I found out the name and address of the previous civil surgeon where I went for my medical and guess what, according to INS civil surgeon locator, his record is not popping up when I am trying to search by zip code, city and state. It means he is no longer a designated civil surgeon. Anyway I have another question, I do have a copy of previous medical that I sent to INS with my all paper work, is it possible that I can use it though it was 2 yrs old at the time of interview? Also what is a guarentee that I would be approved for GC if I take another medical and go to my interview? What if my name check is still pending and then I have to wait for another let's say 1-2 yrs and then they gonna ask for another medical. (which will cost $300 easily). what do you guys think?
Also regarding I-864, I have sent the affidavit of support with the original application with my cosponsor, cuz at the time I was not making enough money, now they are asking me to bring my employment letter and pay stubs, which is not a problem as now I make more than enough to support both of us(me and my USC spouse). so should I take my tax returns for the last year or so to the interview or do I have to find another co-sponsor for my application as my spouse is currently making no money.?
Any suggestions would be greatly appreciated.

Then you may want to consider taking another medical. INS accepts results only in a sealed envelope and this is where the doctor puts the original.
 
It does not matter if is another doctor as long is an approved one by the USCIS. Time to time the USCIS will review the doctors and they can suspend them for their list (that is my logic but you know with USCIS many things have no logic at all) or if the doctor does not longer want to be in that service.

Nothing is a guarantee to get approved, just that take as much as you can -supportive documents- so the probability of get stuck again will be minimum or at least less than before.

In your case, I think they gave you a second interview since has been long time ago your first interview and probably your background check has been clear out. You can check out the memo about it at uscis.gov

About your Affidavit of Support, since things has change you should bring your paystubs if you have your tax return, bring it with you plus your transcripts.

If your income meets the requirements, you don't need a joint sponsor anymore. I understand, your wife filed a petition for you. She needs to fill out a new I-864 (since a long time has passed from the original one), and you would fill out I-864A (both should be notarized). Take copies of your tax returns and the last pay stubs for you and your wife.

My parents were interviewed on July 7, 2005. My dad's case has been pending due to background checks. My mom's case, according to USCIS, can go on after my dad's case is resolved. :rolleyes: How stupid is that... :confused:
BTW, I was told that they have a new rule: If someone gets stuck in the background check, the others who applied together don't wait for him. Their cases continue processing. But, this new rule does not apply to old cases... Can they be any more irrational? :D
Their fingerprints will expire next month, I believe. I wonder, if they are going to be called for another interview? :confused:

Thank you so much you guys are really helpful. yes I would be doing another medical and also filling out the new affidavit of support. I have another question, Is there anyone who has used his medical insurance to cover for medical exams successfuly. I am just pondering an idea about paying through with my medical insurance. I called one Doc. and he said they only take cash or check for INS medical exam. Is it a general practice or what?
 
Usually INS medical is not covered by insurance. But what I was told to do is: I went to take my X-ray and blood test (+vaccinations if needed) at my Family Doctor (so it all would be covered by insurance), then I brought the results to the Immigration Doctor's Office, and they just did general check-up and filled out the papers. It all cost me only $75.

Thanks aniretake, I will def. be looking into that. I found out my earlier medical forms(copy of filled forms from civil surgeaon) Does that mean I don't have to get vaccination (it cost $100 extra)>
 
alright guys I am done with INS for almost 2 and half years. Yes you guessed it right, I got that magic stamp on my passport yesterday after my second interview (after almost 2 years of my first interview). My appointment was for 10:30 a.m., I got there at Newark DO around 9:20 a.m. and it was so disgusting to see that long line even for the AOS interview in the rainy weather. Well what can you do about this? nothing except cursing INS :). Well we got into the building around 10:30 a.m. and went to 13th Floor and handed out appt. Letter. Then we have been asked to wait till out name being called. Another waiting period started and it lasted more than 2 hours. funny thing is that my spouse is leaving the country in the evening at 6:00 p.m. so def. we were frustrated when we got call around 1:00 p.m. ANyway, the lady DO took us into her office and after oath, asked us to show some joint accounts, my new medical, BC and finally she asked me to give her all my EAD's and AP if I have one. I handed over all the EAD's and AP to her and then she said Congratulations and stamped my passport and told me that actual GC will be in the mail in 1-3 months time (I don't care, if it comes in the mail or not :) ) and that's it. It took 10-15 minutes for the whole process and we are out of the building around 1:40 p.m. heading towards Airport which is 2 hour drive from the Newark DO.

PJBlack, it is more like 2 years or less, since you need to apply jointly to remove the conditions during the 90 day period before you complete 2 years on you conditional GC.
 
Thanks patty579 and sgsnathan, yeah SG you would be right if my interview was on or before june 4th (the day we married 2 years back ) :) so I don't have to go for removing those conditions and shell out more money to INS. The 2 and half year period that i mentioned is after which I have to start preparing for my Naturaliztion process. That's what exactly Dist. Officer told me that I just have made it. Anyway she stamped the validity till 2017 or 2016, i am not sure but def. she didn't tell us about anything to remove conditions and I am assuming since we have been married for more than 2 years. I don't have to.
