2nd Fingerprint Letter N-400

Hi

Today i rec'd letter from USCIS for 2nd FP on July 30th, 2009 at 8:00 am in Seattle office. i filled my n400 in July 2007; did 1st FP oct 2007. After almost one year i had my interview on August 2008 which i passed buy IO told me that they will send decision with in 2-3 weeks. since than i have sent:confused: several inquires about my case and every time they said " Name check is pending"

Today i rec'd Letter for FP. any advice will helpful
 
That's actually good news and the fact that you received 2nd FP appointment notice is an indirect indication that your FBI name check is finally complete. Fingerprint results are technically valid for one year and since your first FP appointment was in October 2007, you do need another one. In practice USCIS seems to only send the second FP notice when the name check is complete. So you should definitely go to the second FP appointment at the scheduled time.

I would also suggest contacting both the U.S. senators for your state and the U.S. representative for the district where you reside, and asking them to inquire with USCIS about the status of your application. Moreover, since it has been more that 120 days since your interview, you might consider filing a 1447(b) lawsuit against USCIS.

I don't know about that. I do remember reading about some cases where the second interview was necessary (even if just to update the details regarding travel etc), but I am not sure what will happen in your case.
