245 (i) based AOS interview notices flowing in from USCIS

My neighborer in Georgia got an interview notice from USCIS for AOS. His case is based om 245 (i). He has 4 family member. Does this indicates that 245 (i) cases started eating EB visa numbers or 245 (i) cases has different visa number quota?

majority of 245(i) should fall under EB3 OTHER category. If ur neighbor has a bachelor degree may be he applied under EB3 SKILLED WORKER category.
 
Dude, 3rd "Other workers" category has 5K visas per year limit.
If 245(i) folks are from EB3 Other, then why EB-3 (including India and other countries) is that much retrogressed? Officials explained that by 245(i) influence.

Although most 245i cases should fall under EB3 "Other" there is a loop hole in the laws that states that "two years of experience" in a job can qualify a person for other EB3 categories. A lot of people who filed 245i's used this loop hole and are hence piled up on top of us.

Isn't it nice to know that working as a carpenter or a gas-station attendant qualifies you in the same way as having a bachelors degree from MIT or Stanford. I am not trying to beat down on any profession here but the laws are plain stupid and unjust. We are all paying the price for it now.

Hi Saras,

Just to qualify your answer a little, EB3 skilled (which is equal to professional) requires that the position need 2 years of training or experience. Therefore, a gas station attendant would still be EB-3 other with the 5,000 quota since that position is unskilled and does not need 2 years of training or experience--even if they worked in that position for 10 years. EB-3 skilled tends to apply more to construction trades, chefs, that kind thing.

You are right techincally but lets be real. At those low level jobs one can forge any sort of experience. Two years is virtually nothing. I bet a bunch of unskilled workers filed under the EB3 skilled category. Lawyers can work wonders in order to make money.

It is the inherent nature of people to get ahead by any means whether carpenter or software engineer. I was just trying to say that people who are out of status are even more likely to forge and pad their experience because they are desparate. Most of us would do these things under those circumstances. I have nothing against 245i's. They are trying to make a decent living and provide for their families. My issue is with these stupid laws and the way they are manipulated.
