My wife changed from H4 to H1 and went for a H-1 stamping at the US consulate Chennai, India on 18th of Feb 2005. She was told that the application will be sent to washington for review under visa mantis. Her finger prints were taken and the consulate kept the passport. Since she been stuck in India for more than 6 weeks now,her employer has told her that she will loose her job if she cannot come back soon. She called the consulate to find about the status but no useful info. Can I conatct anybody to know the status of this case?
If she looses her job and mean while if the H-1 visa is stamped what should she do? Also, she has a H-4 visa valid till june 2006. Can she come back on this H-4? (I undersatnd she will not be able to work).
Any help is greatly appreciated.

Hello

Same date, Same Place, Same situation with the passport being held!!

I am still waiting, and following it up with Dept of State (Phone: 202-663-1225). The last I heard, they said it takes rougly six weeks and I am hoping to hear back any time.
I agree it can be painful but nothing much can be done except waiting patiently. You have to try and convince the employer that this delay is beyond your control.

I hope it call comes through soon!

Thanks

Hi,
Thanks for the info. I called DOS yesterday and was told they are waiting on the inter-agency clearance. The FBI fingerprint division told me they donot have anything on this case. ( I gave my wife's last and first name). Any idea what this means? Should I contact the name-check division? Colud you please let me know thro' this forum if you hear anything about your case. We can at least have some idea about the time-frame.\

We are trying to convince her employer, but if she does loose her job,
how do we proceed in order to be able to come back on H-4? ( she has a valid H-4 on her passport). we are worried the consulate might cancel her H-4 after stamping H-1 which might be useless if she no longer has a job.
Highly appreciate your time.
Swamy
