Hi

I am on my 7th year of H1 with approved H1 for the next 2.5 yrs from now bcos of my labor and approved I140.
I have my I485 pending and also have valid AP and EAD even though I am not using my EAD for work purpose. I have also finished my fingerprinting a month back.

I am planning to visit India and plan to attend Visa Staming at New Delhi consulate in 1st/2nd week of december this year.
I had received 221g about 3.5 years back while i was in US when I had applied for my Visa.

#1
If I get another 221g when applying for my visa or because of something else I do not get my Visa Stamped can I use my AP to come back ? I will like to maintain my H1 status.

#2
Are there less chances of getting visa because of a previous 221g.
Anyone else in same situation as mine and will like to share their experience ?

#3
What are the documents that i need to carry along ?

#4
Anything I should be aware of other than normal procedure ?

thanks..Loki.

If I am not wrong, you can re-enter the US using your AP, and still maintain your H1-B status. There's been a few threads discussing this. That way you have no need to goto the US consulate to get a new passport stamped visa.

Good luck.

re : 221g and attending Visa Stamping

Sai_Kumar01 - Are you in India or in US ? I am planning to visit India as I said in December. I did not do anything about my previous 221g.

If I go for the Visa Stamping and do not get it then I can use AP or I should not go for visa stamping at all.
I did not see any conclusive threads about using AP and then still continuing on my H1. Could you please send me the link.

Could gurus look at this thread and advise.

thanks..Loki.
