2008 I-730 relative petition !!!!!!

Hi all:

I married my wife and then we both applied for asylum back in Dec 2006, my wife's case was approved in Jan 2008 and mine was closed this year (it was not approved by officer and it was on pending status) I think it was closed because she filed the I-730 Jan 2008.

1- How long does it take to process the I-730? any similar expirences? I had my BIO done in 2007 for my case, does the USCIS requiers you to do them again? It has been 7 months and we have only received the "receipe" any advice?

2-What happens if you keep your asylum relative approval and you do not applly for GC within a year? how long can you be with this approval? Any one with a similar case?

3- Is it possible (after you have the relative petition approved) to process a labor certification and the GC? (in case you want to travel back to you country of origin and then return?)

4- what are my options to process GC if I divorce after getting the relative approval? can I just apply?

Let me know your expiriences with all this questions.

I am not a lawyer and I may be wrong. Be careful with my answers:​

1) If your wife applied for your I-730 in February 2008, the earliest time you can receive the approval is 2010. They take more time to process applications for beneficiary already in the US. For instance, my son case was approved after 2 1/2 years. Because every case is unique, they may process your case within the normal processing times.

2) The one year is the earliest time you can apply for the Green Card, I am not sure there is a problem if you want to apply after 2, 3 or even 7 years after you received your I-730 approval.

3) It doesn't make sense and they won't consider this kind application for an asylee. For my understanding, it seems the same for a US Citizen or a green card holder who wants to apply for an EAD or a labor certification.

4) If you divorce your wife before receiving your green card, they will deport you to your native country. You have to keep the relationship with the main applicant in order to stay eligible for relative asylee benefits.

How do I write to the Senator? Is there a standard guideline? I really don't wanna go through this all new OPT crap since I'm graduating next May. I've decided that I really can't just wait for USCIS to take an action on my case. I have to do something myself...

Go to your Senator's website. You should find a form to request assistance and also to give him the authorization to contact USCIS on your behalf.

You can attach a letter to this form. There is no template or guideline to follow when you are going to write this letter. Just provide your immigration information, the case number, and why you need the agency to adjudicate your case the earliest possible time.

Be polite, clear, and specific.

Colocolo, thanks for you answers and guidance, by the way I received today my appointment for BIO, one friend of mine just got the relative petition approval for his wife and it took only 13 months, I hope I can be this lucky :)
