Now the priority looks like approving the cases of year 2003.

1) 79% of OCT 2003 applicants have received fingerprint notice,
but 34% of FEB and MAR 2002 applicant's fingerprint are still expired.

2) 5% of NOV 2002 applicants have received RFE,
but only 1% of FEB and MAR 2002 applicants have received RFE.

If only a few of FEB and MAR 2002 applicants take action,
the CSC would adjudicate lot of WAC03 and even WAC04 cases before long-pending WAC02 cases.

Hi Longwait_2001, Kashmir and all EB 485 waiters ...

Talked to Immigration officer as he responded by calling my cell phone to my request to expedite my case.

Had faxed him request to expedite my case which was obviuosly denied. But got a chance to ask him few questions. Below is the details.

Q. Why are the cases from Oct02 and above are processes? These cases have received RFE, some of them have received 2nd FP, and many of them have received approvals?. what is the basis CSC is processing these cases and not touching case between Jan 02 to Sept 02.?

A. CSC follows the Receipt date and # . There is no way EB-I485 cases the date you mentioned are touched. They might be other cases but not I-485 cases. Give me a proof or receipt # of case/cases that you think are filed in FY 2003 or Oct 2002 and are approved. I will investigate.

Q. Sir, what would u do to these cases.? I don't want to put someone in problems and agony that I am undergoing.
A. no we just want to confirm if there were cases that are like yours and filed in FY 2003 and are approved. They won't be affected in any way.

Q. Is there a criteria to expedite EB I-485 cases? Can you expedite my case?
A. There is no criteria to expedite EB-I485 cases and that We cannot expedite your case. You will have to wait.

Q. how long sir?
A. 6 months. We have started working on EB-I485 cases recently.

I had used Kashmir scan results to come up with this numbers. You can also go through the Kashmir scan results.

I talked to the officer again, and he asked me two wac03 #'s as a sample .

Q. WAC0300355036 is the first #. Can you please check why this case was approved even though it was filed after Sep 2002.?

At first he tried to convince me that this case was filed in 2000 and not 2002. I argued saying why is wac number WAC03 .?

A. Ok the case was filed in 2002 and the person was under class of religious worker.


Q. WAC0315153675 is the next #. Please check this last one for me?

A. This case was EB2 class and that is why it was approved.

Q. I know people having EB2 cases filed between Jan 02 and Sept02. why aren't they processed/adjucated first as against wac03.?

A. We get this priority on certain cases from Head Quaters , so we have to process such case.

A. I am sorry I don't know, but it is quite possible that this might fall in different category.

A. Well its hard to tell , but surely there is some thing different from other pending cases , and so head quarter prioritized this first.

In conclusion, this looks like a scam to me. I think there is something wrong going on CSC. Its hard to believe the 413 cases of I-485 are approved that were filed after sep 2002. The officer did not have valid justifications and was trying to cover up details by saying these are different category cases.

I think this needs an aggressive political , media push.
