I started working with this desi company 5 years ago as a fresh h-1b holder. Both my bachelors and masters degrees are from US so h-1b was relatively easy. I worked so hard in this company and make the President who is un-educated millionaire. I was working as a Marketing Manager bring several new accounts for the company. Within 4-5 years the President moved from a 2 bed room apartment to a huge custom made house. This desi employer lied and never paid vacation to it's employees. He and his family take vacation twice a year one at US destinations and one in India. Now there are only 3-4 employee left and even they are looking to transfer their h-1b visa. My adjustment application is pending since past 16 months. Looking at the current market trend this employer make me work 160 hours a month and pay me only 80 hours/month. I give him $20,000 since past 10 months just becasue my AOS application process without any problem. Now all of sudden he decided to move and tell me to look for another job. My problem is I paid him $20,000 under the table or cash. On paystubs it says I have full payment and paid all taxes but in reality I have nothing but cancelled checks. This company also committed many frauds in past and was audited by department of labor once. DOL fined this company and also name of the company was in local newspaper. What should I do to file complain against this desi employe. Please help. My hard earned money is down the drain and also he left me in middle. What if I get RFE now?

No, The company is not Allied.

At this point I want to keep company name confidential so the employer could not file for bankruptcy or merge with other company. The company is based in Piscataway but now moved to Northern NJ.

Dude Looks like SILVERLINE TECHNOLOGIES based in Piscataway is the company you are talking about.

SILVERLINE ( owned by subra brothers ) has done this kind of stuff and they are investigated by NJ DOL, IRS probably INS too.

There are quiet a lot of law suits filed on the company and its owners + management.

So are u talking about Silverline???? Don't worry they can't declare bankruptcy 'cause then their accounts will be checked and they will spend their lives in Jail.

Do one thing, Call a laywer and file a law suit againt your employer if he is not SILVERLINE .
