2 points refuse PR, can my brother appeal

hi all,
my brother applied last year and finally after 12months recieve a letter stating that only 2 points short refuse my PR and my brother came so long awaiting to hear this for the last year and half.
it states that my brother couldn't show proof of my relatives PR. he didn't include that time and now my relatives have everything like PR and job. he can show that.

but i was wondering if he can appeal for the request that short only 2 points and waited so long.... if he can provide all the documents to Buffalo..

would this be possible?
or Canadian Consular is really strict on this?
any suggestions would be great help....

Hi Coolz,

When did your brother get the rejection letter? Exact date.
When did your relative move to Canada?
Is your relative who moved to Canada a parent, grandparent, child, grandchild, child of a parent, sibling, child of a grandparent, aunt or uncle, or grandchild of a parent, niece or nephew who is residing in Canada and is a Canadian citizen or permanent resident?

I suggest that your brother immediately write a letter to the immigration official that his relative has moved to Canada recently and request the officer to reconsider his case.

He needs to submit set of birth certificates conclusively proving claimed relationship. For example in case the relative who moved to Canada is an aunt or uncle you need to submit aunt's or uncle's birth certificate and birth certificate of your parent who is a sibling of claimed relative - both birth certificates must show that you parent and aunt or uncle have same parents or parent.

You must also submit proof that the relative lives in Canada - their Canadian passport or PR Card, Provincial driver's licence, Health card, utility bills, employment or school attendance record, etc.

Hopefully the immigration official will reconsider the case. If not then I will recommend that your brother submit a fresh application as the procedure to apply for an appeal is very lengthy and costly.

he got it day before yesterday Dec. 1st 2005. the moved year and half i would think around mid 2004.

i can get their PR copy and
so do i need to submit my uncle's birth certificate along my parents. it is related to my mom ....

if for some reason if its lengthy then he has to re-file again.
in that case does he has to get police certificate, english test again or just submit new application along with work experience since the time he applied till now. or
does he has to start all over again?would n't they already have all those copies? would be great help to hear again.

I am very surprised :eek: . Why didnt your brother provide the details of your Uncle to the immigration official :confused: ?

Anyway the only hope is to write a letter to the immigration official who sent you the rejection letter and request her/him to reconsider the decision based on the fact that you have relatives in Canada. Please send this information as soon as possible.

To prove that your Uncle in Canada is your relative provide a copy of his birth certificate and the birth certificate of your mother. Both of them should have the same parents. Also submit proof that your Uncle lives in Canada - their Canadian PR Card, Provincial driver's licence, Health card, utility bills, employment or school attendance record, etc. The more information you provide the better it is.

After submitting this information you can just hope that the immigration official reconsiders your brother's case. If he does not accept the new information provided then your brother should apply again.

If he has to submit a new application he will have to get new police clearance certificates, work experience letters etc. He may not have to take the english test again by providing the old score but it is upto the immigration official to accept it.

sorry i never brought up my sister's PR card with you as i totally forgot. the thing was she recieved it last october 2004 and she went once and still in the State due to her job.
is that would work better than uncle?
why i brought my uncle is he has property and job currently..so i thought would be better than my sister.
if it doesn't matter as one's relatives has PR regardless of his/her stay in Cananda then i can have her copy of PR.

do you think he send a copy you would think would be strong case as she recieved PR card i would say around OCt/Nov. 2004
 
To get additional points for relatives you will also have to prove that your relative is currently living in Canada. So I feel that the best option is to provide details of your Uncle.

You can also mention that your sister is also a PR of Canada and provide a copy of her PR card.
