2 I485 pending status

Hi all,

I am a new member of this forum. I have been reading the posts and benefited a lot from them. I have a question and would like to get your advice. Is it not good to have two 485 pending at different centers? Will that jeopardize my GC petition or cause too much trouble? what trouble there will be? Really appreciate if you could share your experience.

My details is as below.

I applied I485 as spouse with my husband's petition at Texas center last year. In the mean time, I am applying GC sponsored by my employer with Vermont center. Recently, I am ready to apply my I485. My company laywer told me that it may cause some trouble later on when two centers are processing my case at this same time and I need to make decision if I want to go for it. Do you have advice?

If I am not wrong, you cannot have two 485 process at the same time. Me and my husband started our GC processing at the same time. Then, my 140 came through earlier then him. At that stage, we had the same question as you do now. The response we got from the Lawyer was that, if there is two 485 application for the same person, it gets voided. Does not matter if you are applying in different service center as at the end, the pull the information from the same central location.

You might want to check with your HR or Lawyer about this.

Thanks a lot for your important information. Does it mean one of the applications will be voided or both?

I checked with my lawyer and got different version. They said it is not against regulation to have two pending status. But immigration officers may get confused and ask for more information.

I am more confused. Where can I confirm the information?

The best way to confirm any information is the lawyer. I am sure they encounter this type of situation quite often, and would be able to suggest you the best way to go.

I don't know if this would help... but I am writing my experience here...
I had applied two I-485 applications for both myself and my wife. One is based on my current employer and the other one was based on my future employment.
INS has sent an RFE, asking why I have two applications and they have also requested my employment letter and three months paystub from my current employer. My attorneys, both current and future employers suggested that I withdraw one of the application... I decided to withdraw the future employers i-485 application...

I guess at the end they would want to know who you'll be working for and what i-485 application to process...

It does not carry much meaning to process two I485 applications.
Choose which one is a stronger case and stick by that. Don't bother about the time it takes to get the GC. Both options will take same time.
