Hi,
Please advise on my case. Here are the details.
I took pre approved labor (EB2 July 2003) in Jul 2006. Got approval in 10 days. But on Approved I140 priority date is incorrect USCIS typo Jul 2006 on approved I140.
My Attorney sent 5 times inquire to USCIS to correct the I-140 priority date but USCIS never did it.
So we filled New I-140 and 485 (concurrent filing) on June 4 2007 as priority date current at that time. As soon As we filled new New I-140 and 485, i got old I-140 approval correct priority date from USCIS on June 20, 2007. (I got 485 receipt notice, EAD, AP and Finger prints).
My question is can we send cover letter to USCIS with corrected priority date approved I-140 attach to 485 receipt asking withdrawal of Just New I-140 at the same time want to continue I-485.
