2 FPs and no RFEs?

Hi everybody,

I already got 2 FP notices and no RFEs. Is it possible to get the case approved without an RFE request or does BCIS always requests one?

I imagine that they always request one, but just want to make sure that I should be waiting for an RFE first and not hoping for an approval just yet.

Is anybody else in the same situation?

RD: 12/14/01
ND: 12/20/01
1st FP: 02/02
2nd FP: 07/09/03
2nd FP recieved by BCIS: 08/26/03

Thanks!

Yes it did. I took my prints on July 9th and it says:

Current Status:

On August 26, 2003, we received your response to our request for evidence or information. It is taking between 570 and 600 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.

BCIS does not ask for RFEs on all cases. It's possible your will be adjudicated without one. It all depends on the officer it's assigned to as well as the particulars.

Russian,

Your posts are a little confusing. You said you didn't receive any rfe but your current status that you posted clearly indicates that BCIS has received your response for the rfe. How is this possible without an rfe being issued. This message doesn't look like a standard 'finger print results received' message(unless it is different for the second fp).

I am curious, is it possible that your lawyer might have responded to any rfes on your case without your knowledge?

Please keep us posted.

For my second FP, BCIS posted the status: "Additional Info was requested". So, at first my lawers and I thought that it was an RFE request. I was really excited. Then, it turned out to be that it was just a request for the 2nd FP. After I got my prints taken on the 9th of July, the message was updated saying that 'We received the additional info requested on Aug 26th'.

I thought that this is what they usually post for the FP notices, don't they? I assumed that the 'Additional Information' can either mean FP or RFE. If not, than it is strange. It's almost like BCIS is treating my 2 FP as an RFE. I've been talking to my lawers and it doesn't sound like they've received anything else.

If this is not how FP requests are done, than it's really confusing!

Usually this is what the message looks like for FP results.

"On....we received the results of your finger prints and the processing has resumed...................."

But in your case BCIS(or whatever it is called now) seems to be treating the 2nd FP as an rfe. This may be good for you as you may not even receive another rfe and your case might get approved with no further delays.

Russian:

"I assumed that the 'Additional Inforamtion' can either mean FP or RFE."

This assumption is probably right. My case was transferred to a local office and on the day of the interview, my FP had expired (missed it by about a week). At the end of the interview, the officer said that everything was in place except that the FP have expired. He also handed me a formal letter, an RFE, requesting me to appear for a second FP by a certain date. He mentioned that the letter (RFE) was a formality and he could actually schedule for a second FP right there (unless I wanted to come some other day --- of course I opted to have the FP done the same day). Within a week, the local office sent me the approval notice.

Goodluck with your appl.
