1Victim, I read in your signature about your AC21 usage. Did you get any RFE after you file AC21. Please reply to my following issues. My present employer is troubling me like anything and want to change to another employer.
My I-140 has been approved 4 months back and I-485 is pending more than 7 months. So I am planning to use AC21 and in one of the thread, one of our member posted different letters for AC21 like Cover Letter, Supporting Letter, Employment Verification Letter and other AC21 attachments. How should I send all these letters, I mean in one single cover?
Is there any specific title or heading need to be written on the cover in bold letters like AC21 and case number?
Also how sure we are that these letters will go into our files which give adjudicators the information about our AC21 usage. Please apologize if my questions appear to be childish?

Also with me are my wife and my kid I-485s pending, do I need to include their cases too in my AC21 or should I send different AC21s for my family members separately? Which letter exactly I should mention about my family's details informing to USCIS. And lastly, What would be probable negative effects of using AC21.
1Victim, you can PM me with the details how you used AC21 and what are the letters and documents to be sent to USCIS. Your reply would greatly help pull me out of this misery.

You can invoke AC21 perfectly without any problem. If I were you, I would seek my attorney's help to send AC21 documentation to BCIS. Worth spending few more hundreds of dollars when former employer is brutal. better to send AC21 documentation as soon as you quit so that your employer will loose control on I140. If you are not sure about your attorney's co-operation, hire some one else by sending G-28 form to BCIS.

I invoked AC21, but never checked with BCIS if they had it on my file. I am not sure if I can get that confirmation by calling BCIS. Ginnu can answer this. But, I will try anyway.

also, it is good to have copies of approved LC, I-140. If you dont have them, file FOIA.

Thanks for your quick reply. It gives me morale boosting and strength. I have decided to switch over to another employer next week, since our FPs are scheduled for April 8, 2005. I have original I-140 with me but not LC copy and I am sure the present attorney would not help me to get job description to file with AC21, as you said I may have to file FOIA.

chito123, could you please give me some more info about the process of FOIA. Also since you already filed AC21, in my case along with me my wife's and my kid's I-485s are also pending. How about these cases? I mean do I need to inform their cases to USCIS and do my family need to file AC21? Could you please elaborate a little bit on this, if you have more info.

AC21 documentation should be sent on behalf of primary applicant. dependents don't have to do anything. some ppl are filing AC21 by themselves. But i did it with help of my attorney.

FOIA - visit http://www.uscis.gov for FOIA forms. It is very simple form to fill. attach copy of I-485 receipt, I-140 receipt etc. If you need furhter help on FOIA, you can search in this forum on key word "FOIA".

Do not worry, just change the employer, but make sure you will get the employment letter from the new employer and company financials. If you company is big then you can just submit 10-K (annual report). I did that and got approved. See my signature.

Thanks for your posting. All our members' posting are really boosting the morale.
Did you proactively filed AC21 or filed after getting RFE? How about your attorney, did you change him after moving to new employer or retained the same attorney? Your inputs will help me a lot.

I did not...

file AC 21 proactively. Once I got RFE, I told that I want to use AC21. They started necessary paper work and charged the extra fees. I used the same attorney becos the attorney was not my company's attorney and was an external attorney. since i also paid my gc expenses to my ex employer, only thing I got from my previous employer was a release letter to the attorney that they will not be responsbile for any future expenses for me even though they were not. But for safer side they did and everything went fine.
