I am a Mexican-born man trying to get a Green Card. After getting an I-130 approved, I filed I-485 with my wife in 2001, but the marriage didn't work out and she eventually withdrew the application, stating that the marriage had been entered in good faith but that the marriage had soured. I then received a notice that I had 30 days to leave the country.
I never did so. I married a different woman in 2002 and refiled I-485 with her. My interview is coming up quickly, but now I am thinking about that 30-days-to-leave notice and wondering about it. Will my I-485 automatically be denied because I didn't leave when ordered to do so, or is the important thing that I'm now within a marriage? What worries me more, are they calling me for this interview of Adjustment of Status just as a ploy so they can detain and deport me when I arrive? This seems unlikely to me since I went for fingerprinting a month ago and wasn't detained then. But I'm nervous.
can someone please explain to me what role that 2001 notice to leave the country will play? An immigration attorney friend of mine said it didn't apply to me and is just something they put on every cover letter when denying someone's I-485, which seems odd to say the least.
