1st I 824 got separated from file 2nd I 824 lost

Hi

My husband submitted an I 824 for my son to follow to join in Jan 2002. Texas worked this case (and case became separated) before they approved my husbands I 485/green card so was denied in Oct 2002

The denial letter said to send another I 824 for son once husbands I824 was approved. Husbands I485 was approval April 2004

The 2nd I824 was sent in early May 2004 and approved 11th Aug 2004. Cable sent to London on this date

As neither husband or son heard from London, we wrote and called them. Even though the case status on line says approved and cable sent etc., London says never received it!

Called Texas, they said call DOS. The DOS says call London and guess what?? London says call Texas.

Iwrote to my congressman on 19th Jan 2005 saying I was going round in circles. He in turn has written to Texas and still waiting a reply

God help them if they make us do a 3rd I824 from scratch.

Any suggestions as to what else we can do? as he is the only son left to follow to join and on his own

Sue,

check with London embassy if they accept an AC140 based on the I824, and try to get a consulate interview. I am assuming that your husbands case is I140.

If they accept; send in a AC140 packet (see immihelp.com) with I824 reciept/approval notice to London and explain the situation in a cover letter. Even if they dont accept , notify your situation to London in writing, preferably through your attorney.

I have not heard so far that the USCIS contacting the Consulate directly on approved Immigrant Visa cases. Normally it is through NVC. You may check with NVC also if they can create a case based on the I824 and approved Primary petition.

Congress men and Senators can (and most will) help, though it takes time for them as well.

Thanks for your reply.

I have sent a cerified letter to the London Consulate on the 19th Jan 2005 with copy approvals husbands I140/green card approval, copy of 1st and 2nd I 824 denial and approval and a stamped address envelope (otherwise they will not answer) still waiting a reply. I had hope they could set up a case number/file or whatever they do

I have also faxed Texas and congressman on 19th Jan the same info and as of todays date no-one has got back to me

My Attorney has checked with NVC and because he is a CSPA follow to join case and hubby changed status in the US, the file goes direct to London for them to process green card and not to NVC

I do not understand what you mean by AC140 but will go to immihelp as you suggest and see what I can find out.

I guess my next course of action would be letter to Odbusman, letter of complaint to the director of TSC or legal action

What a mess! I will post back any progress and appreciate any help/advise from you guys

i824....

hi,
im from the uk and my wife in florida filed for me a i130.....been approved 1st sep 04.....because i was not in the usa at the time we then had to file a i824...we did in oct 04...the date for ours is 18 nov 04 at csc...this i824 form is bs......its got to be the worst forms out there......why have people who got approvels got to go back into the cue again!?.....you pay $195 for what?...
anyway after 5 months of waiting cas its only moved 7 days towards our date ......i e/mail csc.....there reply was......
your i824 is in line for adjuicating.....if your i824 is approved your allready i130 will be sent to the nvc......
i know you said it goes direct to london.....but it might be worth a call to the nvc.......maybe!.......its just an idea....
