One of my friend who is having an interview(IV) next month is currently working in India and has the following questions :

1) He came to the US in 99November last week, but did not file the W2s for the year 1999.

2) In the year 2002 he made only $30,000.He was in India for 4 months and wan on bench for 45 days(unpaid).

As of now his employer is still willing to hire him and pay him salary mentioned in LC.

Do you see any red flags in his case ?? Please suggest !!

1) He came to the US in 99November last week, but did not file the W2s for the year 1999.
Answer: Did he work in 1999? If yes then he should have a w-2 else it is not required.

2) In the year 2002 he made only $30,000.He was in India for 4 months and wan on bench for 45 days(unpaid).
Answer: 45 days bench time is not really a red flag. Normally companies are required by law not to do benching without pay!

3) As of now his employer is still willing to hire him and pay him salary mentioned in LC.
Answer: As long as his employer is willing to give him a employment letter that is notarized with salary & position stated in that letter it should be fine.

But as always wait to hear back from a couple other senior folks and also post same question on other forums such as goetcher's forum or on murthy chat to get a feel for everyone's opinion!
