When does the 180 days count start from?

Is it from INS received date or from Notice date?

Please clarify?

Good question

Honestly, seems to be nobody knows for sure:confused:. Have been looking for an answer to such question last two months, and the best I got is this:

If you DID NOT filed concurrently, and have the I-140 already approved. The date is 180 calendar days after the date noted in the I-485 receipt.

If you filed concurrently, all your receipts should have similar date, but it will only count if you have the I-140 already approved.

Since the BCIS doesn't have any ruling regarding the specific issue, and concurrent filing is a "temporary trial" nothing is really clear about the issue.

Any way, take it as an opinion of somebody in a similar situation looking for an answer.:(

I agree with Rich. Nobody knows for sure, including BCIS and GOD.

As far as I know/guess,
180 days count starts from Received Date. But it is always safe to count from Notice Date, which comes later.

When can use AC21 rule:
1. If you have filed I-485 with approved I-140 then 180 days starts from the Received Date.

2. If you file concurrently then
a) if your I-140 approved within 180 days then you can use AC21 rule on 181st Day.
b) if your I-140 approved in 200 days then you can use AC21 rule on 201 day.(Next day after your I-140 approval, if it crosses more than 180 days)

My guess is that when they published the AC21 rule, there were no concurrent filing and approved I-140 was the basic eligibility for using AC21 rule.

Again these are just my guessings only. Consult with your attorney for advise.

The AC21 was previous

The AC21 is way earlier than concurrent filing which started as an interim attempt to reduce the backlog :rolleyes:; it has been in place since July 02, and still is in "provisional" status.

Already asked the attorney, yes you guessed right he doesn't know either :rolleyes:

I was funeled to file concurrently, which looked as a shortcut, but after the BCIS took over, and all times ar constantly stretching at a factor of 90 days beyond the current date (at least at TSC); doesn't look that good.
It's totally frustrating:mad:, only GOD knows when we would be out of this tunnel.

Any similarity with a 3 World Country public administration is just a coincidence...:mad:
