180 Days - Complexity

Hi
I have completed 180 days from receipt date and 15 days short of 180 days from ND. Here are my options. I have valid EAD and AP never used.
I have only 6 months left on H1B.

1. Accept the terminating letter with 2 weeks of notice period which completes 180 days from notice date and look for a job using EAD.

2. Accept for 30% paycut and work for 90 days. This pay would be less than
less than mention on H1B petition and labour certification.

Added to this I have to file I485 for my wife who will be entering on H4 this week and need a job letter from current employer in order to sponsor her!!

HR had spoken to attorney for leave of absence and all options but attorney is not comfortable with them. She is not comfortable with paycut also.

I am anticipating minimum RFE for the following in worst case scnerio

1.Employment letter from employer who sponsored I140
2.Recent or last 6 month paystubs and tax returns
3.Job description letter from future employer if I use AC21 180 day rule.
4.If i use 180 day rule INS might ask for item NO.1 because they might say u may switch jobs in between but u need to work after u got the GC.

As I keep thinking there are endless permutations and combinations and was unable to take any decision?
Any suggestions are greatly appreciated.

Thankx Friends

I tried calling Tracy Renaud - Adjudications officer for 180 day ruling but got her voice mail. I will try some time later in the day again.

Now thats a dilemna .
Usually they RFE for last 3 paystubs . In case you are getting
paid biweekly it is only 1.5 months .

Since VSC is processing faster you are looking at another 6 months
of wait . There are lot of cases where INS approves without any RFE.
That would be the best case which we all can hope for .

To plan for the worst case , this is what I would do :
I would consult attorneys like Sheela Murthy or Rajiv Khanna .
I guess they charge 150$ an hour , but its worth it .

Also consider this scenario :
You have another 3-4 months before INS picks up your case .
Work for your company at reduced pay . Ask them to hold your
pay for this period and start paying this held up money after
that so you can have full pay to show it to INS .

Good Luck !!!
