180 Day Rule ??

Do we need be on EAD to be able to use 180 Day Rule ?

    I filed my I485 2years back and I am currently on H1B, not using EAD eventhough
    I am holding a Valid EAD ? Am I eligible to switch jobs if I get laid off ??

    (for those who don\'t know 180 Day Rule: switching jobs 6 months after filing 485 )

this is a good question. my lawyer seems to think it\'s OK to switch but he cautioned me to get a new H1B with the new employer if possible, just in case. some people seem to think it\'s OK while others are not so sure. i think the fact is nobody knows for sure. it might be wise not to use this - if possible.
