180 Day Rule ??

Do we need be on EAD to be able to use 180 Day Rule ?

    I filed my I485 2years back and I am currently on H1B, not using EAD eventhough
    I am holding a Valid EAD ? Am I eligible to switch jobs if I get laid off ??

    (for those who don\'t know 180 Day Rule: switching jobs 6 months after filing 485 )

I\'m guessing what you are attempting to state is that in your current job, your I-9 was checked using your H1-B rather than your EAD.
Frankly I don\'t believe it matters. Either one could be used for validation in your current job. Most people redo an I-9 because their H1B has expired. If your H1 is still valid, you do not need to re-do your I-9.

Also, remember that whether or not your EAD was used to validate your I-9 it is still valid and will need to be used to switch jobs. Always have an unexpired EAD with you becuase if you get laid off or fired you can use the EAD to switch jobs. The EAD will also expire in one year automatically whether or not it was used to validate the I-9/.
