My employer filed 140 with a letter statement from the vice president showing employers revenues. An RFE has come out of this indicating that it is not an accepted evidence for ability to pay because company size is less than 100 employees. They have now asked additional evidence to establish that the employer had the ability to pay the profferred salary as of Apr 2001 (labor PD), the date of filing and continuing to the present. Submit 2001,2002,2003 and 2004 IT returns with all schedules and attachments for your business.
In addition they have asked if prospective employee is filling a newly created position..If no, show salary of incumbment, and proof that the position was indeed vacated by submitting copies of Form 941 for the period in question.

What do they expect to see in my employers IT returns to approve my 140. Does the employer have to show profit for all these years ?
