140 RFE Labor Sub

I just got an email for my I140 filed using substituted labor in July 2006. The original 140 application was submitted with education evaluation (I have a proper 4 year degree and 2 year masters from well know univs in India). I also submitted experience letters and my company is a well known listed company on NASDAQ.

My current salary in 2007 is higher than what is mentioned in LC. However in 2006 I opted for an international assignment to India for 6 months. Since the move was my initiative, company did a cost of living adjustment and as a result my 2006 W2 will be less than salary on original LC. Could this be grounds for RFE? What should the response be for such a situation?

since your education and company's ability to pay seems to be good, the only thing they might ask about is the language used in the LC you substituted..But this is USCIS, you never know, sometimes they even ask for the documents you already submitted with the app.
